MARRIAGE IN UKRAINE TO A UKRAINIAN NATIONAL:
SOME ASPECTS OF PROCEDURE

An extract from the British Embassy Website in Kiev

If you intend to get married in Ukraine you will be asked to produce at the local Marriage Office (ZAGS) the following documentation:

- Certificate of No Impediment (CNI);
-Certificate concerning termination of your previous marriage (if applicable);
-Certified translation of your British passport;
-Some marriage Offices may also require your Birth certificate

The CNI can be obtained both in the UK from your local registrar’s office or here at the Embassy.

If your document was issued in the UK, it requires an “Apostille” (legalisation certificate attached to the document) (please contact the Legalisation Office, Foreign and Commonwealth Office, Old Admiralty

All documents must be translated into the Ukrainian language.

If you decide to apply here in Ukraine please note that you will have to stay here for at least 21 days prior to your application. The Certificate, if no impediment has been shown to us to exist, will be issued to you in 21 days from the moment of your application.

To apply for the Certificate you will have to come to the Consular Section of the Embassy, complete Notice of Marriage and swear affidavit (please contact us in advance). The whole procedure will cost you £118 in local currency (£59 for the Notice of Marriage and £59 for the Certificate of No Impediment).

Once you get the Certificate, it should be legalised at the Consular Division of the Ukrainian Ministry for Foreign Affairs (2, Velyka Zhitomirska Str, Kyiv 01018, tels 238 1669, 253 1596, 238 1815).

Ukrainian President Viktor Yushchenko signed a new Law, which has been passed by the Parliament on 22 December 2006, amending Family and Civil Codes of Ukraine. The new Law introduces a requirement for those who are going to get married to inform each other of their state of health. The State is obliged to provide adequate conditions for the appropriate medical examination.

There have been reports in the press suggesting that this medical examination is obligatory and couples would therefore not be able to get married without passing medical tests.

The Ministry of Justice of Ukraine has, however, published an explanatory note on 19 January 2007 (www.minjust.gov.ua), stating that medical examination will be done on a voluntary basis only. The

Marriage Office must inform the couple that they can take medical tests if they wish to do so. If the couple does not want to take the tests it will NOT be an obstacle for the registration of the marriage. They can "inform" each other about the state of their health without taking medical tests.
